Opting to resolve a dispute via mediation is an ever-popular method of attempting to reach a settlement that all parties are satisfied with on terms upon which they agree as opposed to terms imposed upon them by others. An agreement reached at the end of a successful mediation is final and binding upon the parties providing that it is appropriately documented in an enforceable written settlement agreement.

When preparing for mediation we can work with you to advise on how to organise and communicate your case to a mediator and the other party or parties. Acting as Mediator

As well as representing a party in mediation proceedings, our Mark Trotter can also act as a mediator between disputing parties. Mark is an accredited mediator and has acted as mediator in various multi-million-pound disputes. Mark remains completely independent throughout the process and is able to use his 30 years of experience in the construction and rail sectors to understand the position of each party and help them narrow the issues by finding common ground between them along the way to settlement.

Mark will discuss the strengths and weaknesses of each party's case with them in private sessions and encourage them to adopt a less entrenched approach with the other party on matters upon which have a less certain outcome in any formal tribunal.
Following an agreement to mediate, we will send all parties our terms of appointment and mediation agreement for signing. We will advise on the necessary steps to facilitate an effective mediation. Afterwards we will oversee the drafting of any settlement agreements that result from the mediation.

Adjudication

Most construction and rail contracts contain provisions for disputes to be resolved by way of adjudication. Adjudication allows disputes to be resolved in a manner that is both quicker and more cost effective than either arbitration or litigation. Adjudication can be used in resolving claims that relate to a whole manner of contractual disputes but most typically these include interim payments, disruption to works, defects and the final account.

If a dispute reaches adjudication proceedings, we can prepare the documentation and evidence for your claim acting as party representative for either a referring or responding party.
